Background

The Kenya Pharmaceutical Association (KPA) is the professional body representing all Pharmaceutical Technologists enrolled in Kenya. With a membership of over 14,000 professionals drawn from eleven branches across the country, KPA members serve in diverse capacities across the healthcare and pharmaceutical sectors. This professional diversity underscores the Association’s commitment to its Vision: “To be a leading professional association in the promotion of quality pharmaceutical practice,” and Mission: “To promote excellence in pharmaceutical practice.”

In pursuit of its mandate and operational excellence, the Association seeks to engage a qualified and reputable Advocate or Law Firm to provide comprehensive legal services for the period 1st August 2026 – 31st July 2027. The engagement shall be renewable annually for a maximum of three consecutive years, subject to the resolutions of the Annual General Meeting (AGM) held every July.

Objective

The appointed Legal Officer / Law Firm will be responsible for managing the legal affairs of KPA by offering timely, strategic, and sound legal counsel grounded in applicable laws and regulations. This includes ensuring compliance with:

The KPA Constitution
The Constitution of Kenya (2010)
The KPA Code of Ethics, Self-Regulation Standards, and Safer Pharmacies Charter
All relevant statutes and regulations governing the pharmaceutical sector

The legal services will include reviewing, drafting, and advising on the adequacy of KPA’s legal documents; providing legal opinions and representation in litigation and other legal matters; formulating and executing optimal legal strategies; supporting the National Executive Council (NEC), Branch Executive Committees, and other organs of the Association as approved; safeguarding the interests of KPA and its members in line with emerging and existing laws and regulations in Kenya; and proactively minimizing legal and regulatory risks.

Scope of Work / Responsibilities

The successful legal officer or firm will be expected to:

Provide legal advice, guidance, and representation on issues related to pharmaceutical regulations, healthcare law, and professional ethics.
Review and develop internal policies, bylaws, codes of conduct, and governance documents.
Conduct legal research and analysis to support sound decision-making and compliance.
Stay abreast of changes in legislation, policies, and regulations affecting the pharmaceutical profession in Kenya.
Draft, review, and interpret contracts, MoUs, service agreements, and other legal instruments.
Represent KPA in legal proceedings, including litigation, arbitration, and mediation.
Advise the Association on emerging legal risks, compliance issues, and dispute resolution strategies.
Conduct legal capacity-building sessions for KPA members on pharmaceutical law and ethics.
Support the National Executive Council in ensuring KPA operates within the required legal and regulatory frameworks.
Provide general legal support as requested and approved by the National Executive Council.

Minimum Qualifications and Competencies

LLB Degree from a recognized university.
Advocate of the High Court of Kenya with a valid Practicing Certificate.
Minimum 6 years of post-admission experience, with a focus on healthcare, pharmaceutical law, regulatory compliance, or closely related fields.
Demonstrated understanding of Kenya’s legal and regulatory environment affecting the pharmaceutical sector.
Strong analytical, conceptual, and negotiation skills.
Proven experience in legal research, contract drafting, and representation in court or alternative dispute resolution mechanisms.
Excellent written and verbal communication skills, with the ability to convey complex legal concepts in a clear and accessible manner.
Member of the Law Society of Kenya (LSK).
The applicant must be part of a registered and licensed law firm that has been in operation for a minimum of five (5) years.
